"Τι πρέπει να γνωρίζετε για τη δήλωση του Κτηματολογίου:


Η δήλωση στο Κτηματολόγιο είναι υποχρεωτική για όλους όσους έχουν δικαίωμα σε ακίνητο (π.χ. κυριότητα, επικαρπία, δουλεία).


Σε περίπτωση που ένα ακίνητο ανήκει σε παραπάνω από ένα άτομο, πρέπει να το δηλώσουν όλοι όσοι έχουν δικαίωμα σ΄αυτό.


Η δήλωση στο Κτηματολόγιο δεν σχετίζεται με τη δήλωση του Ε9 για τη φορολογία.


Η διαδικασία κτηματογράφησης διαρκεί περίπου τέσσερα χρόνια και ξεκινά με την υποβολή δηλώσεων ακίνητης περιουσίας".


Declarations of property ownership


Initial Registrations and Correction Deadlines


"Initial registrations are the ones that appear in the cadastral book of a region, as transferred from the cadastral tables, after the completion of the cadastral survey and before the commencement of the Cadastre’s operation in that specific region. Every posterior registration of a right is based on the initial registrations.


In case there is an inaccurate Initial registration it is possible to dispute and correct it partially or in the whole within seven (7) years from the date when the Cadastral Office began operating in a specific region. This deadline applies to local residents, the Greek State, people residing abroad or people who work permanently abroad (Law 4361/2016).


Especially for regions included in the cadastral survey programs of years 1997-1999, the deadline mentioned above is fourteen years (14) years for local residents, the Greek State and people residing abroad or people who work permanently abroad (Law 4361/2016).


Correction Procedures


The type of error the Initial registration contains also defines the correction procedure. More specifically, the law distinguishes between the cases which require an irrevocable judicial decision and the ones that are due to an obvious error and can be corrected administratively, without judicial intervention but with a decision by the Head of the Cadastral Office.


After the expiry of the deadlines mentioned above, the Initial registrations become final and they produce an irrefutable presumption, meaning changes in their content are prohibitted.


The correction deadline begins when the decision of Ministry of Environment & Energy, with which the entry into force of the Cadastre in the surveyed region is decided, is published in the Government Gazette.


Properties recorded to belong to an “Unknown Owner”


Properties (or rights on properties) which for any reason were not declared during the cadastral survey are recorded in the cadastral database as belonging to an “Unknown Owner”. For the correction of the initial registrations of “Unknown Owner” into a known owner, the same procedures –judicial or administrative correspondingly depending on the case– with the ones for the erroneous registrations stand. Specifically, the interested party should comply with the correction procedures that are laid down, after he/she has already located their property.


Update of Cadastral Registrations – Entry ofDeeds


The procedure for updating the cadastral registrations includes the following four (4) stages:


1. Citizens file an application for the entry of a registrable deed; the Cadastral Office collects the application.


2. Legality inspection – the Head of the Cadastral Office decides whether the registrable deed will be entered or not.


3. The registrable deed is entered.


4. A Cadastral Sheet (CS) is issued for the archive and the old sheets are substituted in the Cadastral Book (CB). The alphabetical index of beneficiaries is updated; the deed and supporting documents are filed away.

Filing an application for the entry of a registrable deed

In order to enter a registrable deed on the Cadastral Sheets, it is necessary to file an application to the Cadastral Office under whose competence the property referred to in the registrable deed comes.

The application can also be sent by post or courier, provided there is prior communication with the Head of the Cadastral Office and he/she has agreed to this.

In case the registrable deed involves more than one property, then, provided that all properties come under the competence of a single Cadastral Office, the application is filed to this Cadastral Office only. If the properties come under the competence of more than one Cadastral Office, then you need to file different applications to each of the co-official Cadastral Offices, so that every Cadastral Office proceeds with registering the property/-ies coming under their own competence.

If a property comes under the competence of more than one Cadastral Office, then you need to file different applications to each of the co-official Cadastral Offices; every Cadastral Office proceeds with registering the same property, noting that part of it comes under the competence of a different Cadastral Office.

The Head of one of the co-official Cadastral Offices or whoever has a legal right can petition the issuance of a decision by Ministry of Environment & Energy ruling that the total of a property will come under the competence of one single Cadastral Office out of the multiple ones it previously came under.

The following are noted regarding the filing of the application:

1. The following documents need to be filed together with the application:
The registrable deed whose entry on the cadastral sheets is petitioned,
A summary of the registrable deed ( HEMCO BoD Decision No 411/02/3.4.2007, Government Gazette 1077/Β΄/2.7.2007),
Documents proving the legalization of the person signing the application (article 14 of law 2664/1998),
A certified extract of the cadastral diagram (or a copy of this, since the certified one is kept with the notary when it comes to contracts).

2. If the deed whose entry is petitioned is a real property legal transaction, then it is compulsory, on penalty of invalidity (nullity), to attach to it a certified extract of the cadastral diagram. In this case, it is a necessary to have previously applied for the issuance of a cadastral diagram extract.

3. If the application for the entry of a deed is filed by a proxy, legal delegate or representative of a legal entity, then the documents proving the legalization of the person filing the application need to be attached to the application.

4. On filing the application and supporting documents to the Cadastral Office, a formal check for the completeness of the filed data and the relevant competence of the Cadastral Office is performed.

5. Afterwards, the fees and rights which need to be paid for the entry of the deed are calculated. If the relevant fees cannot be paid, then the application is returned.

6. Applications are registered in the Journal on the same day. Their registration is in chronological order of filing. Every application is numbered according to its filing sequence and also reads the date when it was received by the Cadastral Office. This date is also noted in the Journal and the fees voucher.
